Draft of the EU Deforestation Regulation Excludes Raw Hides and Leather from Its Scope

In response to global calls from the leather industry, a recently adopted delegated act draft by the European Commission has officially proposed amendments to the EU Deforestation Regulation (EUDR, Regulation (EU) 2023/1115). The Annex of the regulation removes raw hides and leather items under tariff codes 4101, 4104, and 4107 (other raw hide and leather products under Chapter 41 were not previously included). This means that raw hides, semi-finished leather, and finished leather products will no longer fall within the scope of products regulated under the EUDR.

In response to earlier proposals to include raw hides and leather within the regulatory scope of the EUDR, the China Leather Industry Association formally sent a letter to the Mission of China to the European Union. The letter elaborated on the industry’s position that raw hides and leather should not be included, from the perspectives of raw material characteristics, supply chain realities, and the development of China–EU leather trade.

The association emphasized that leather is a by-product of the livestock industry and is not a driver of deforestation. Leather processing also provides value in resource recycling and low-carbon sustainability. It further pointed out that the requirement for full-chain traceability of farm geolocation lacks practical feasibility and would significantly increase compliance costs for Chinese exporters to the EU, effectively creating trade barriers, and could potentially trigger a chain reaction of regulatory expansion across all leather-related products in the EU.

The Mission of China to the EU attached great importance to this issue and conveyed China’s position to the European Commission to promote the exclusion of raw hides and leather from the scope of the regulation.

Meanwhile, the China Leather Industry Association has maintained close communication with international leather industry organizations and actively carried out related coordination efforts. With the reasonable demands of global industry stakeholders and joint efforts from relevant institutions, the European Commission has adopted the recommendations from the leather industry.

According to reports, the draft still needs to go through the full legislative process. In May, the EU will launch a public consultation on the draft, and the delegated act is expected to be formally finalized and issued in the summer of this year. After publication, the European Parliament and the Council will enter a two-month objection review period.

The China Leather Industry Association will continue to closely monitor the progress of the EUDR, strengthen coordination with international and national industry organizations, actively participate in the upcoming public consultation process, consolidate existing outcomes, safeguard the legitimate rights and interests of China’s leather industry and enterprises, and ensure the stable and healthy development of China–EU leather trade.
